Polygraph Licensure

Under Article 5, section 5c of the Wage Payment and Collection Act, the WV Division of Labor has the responsibility for the licensing of polygraph examiners. Under the language of this Code, the Labor Division also prohibits employers from requiring any employee or perspective employee to submit to a lie detector or similar test to ensure employment.

Exceptions to this requirement are those employees who are working with prescription drugs, and also for those employees who hold a license to perform polygraph examinations for law enforcement agencies and military forces.
